This document consolidates the defamation, harassment, platform-failure and financial-damage material for Anthony "Soul" Brodie, the sole developer and operator of Legion Killfeed.
The campaign is not a normal customer dispute. It is a connected cross-platform attack involving false accusations of pedophilia, fraud, hacking, file theft, token abuse, malicious code, server sabotage, drug abuse, doxxing, suicide encouragement, rape threats, fake reviews, search amplification, and platform refusal after notice.

Legion Killfeed is a Discord-based automated killfeed and server analytics service for the DayZ gaming community on consoles. Soul is the sole developer, operator, and proprietor. The service provides real-time kill notifications and server metrics to DayZ game server communities via Discord bots.
| Metric | Value |
|---|---|
| Total Addressable Market (TAM) | Jeabers cumulative unique baseline (not concurrent active): 9,140 servers / 2,222,899 players (historical tracked total). Jeabers active final snapshot baseline: 3,709 Nitrado servers / 3,179,161 players. |
| Total Nitrado Servers Using Legion (since beta) | ~1,272 servers (cumulative unique footprint) |
| Cumulative Server Penetration vs Jeabers (9,140 unique) | ~13.9% (1,272 / 9,140) |
| Cumulative Server Penetration vs Jeabers active final snapshot (3,709 Nitrado) | ~34.3% (1,272 / 3,709) |
| Peak Reference Share (proxy vs active final snapshot) | 4.58% (170 / 3,709 servers - April 2025) |
| Trough Reference Share (proxy vs active final snapshot) | 2.40% (89 / 3,709 servers - Dec 2025) |
| Competitive Landscape | 4-6 competing killfeed bots exist (DayZKillfeed.com, Killfeed.Dev, DayZ++, Laws Killfeed, DayZero Killfeed, SkyNet and more) - only one offers Legion's global functionality with accuracy and comparable technical advancements (Note: SkyNet is built off stolen Legion code and would not exist without it) |
| Player Base Capture | 1,273,369 players tracked (per bot statistics, 21 Oct 2025) - 57.3% of the Jeabers cumulative unique playerbase (1,273,369 / 2,222,899) and 40.1% of the Jeabers active final snapshot playerbase (1,273,369 / 3,179,161), reached at a fraction of the total server count (13.9% cumulative server penetration). |
| Industry Contribution | Identified and reported a caching flaw to Bohemia Interactive that improved global CPU usage by ~40% |
February 2023 - June 2024: Legion Killfeed ran as a free beta for 17 months before the paid subscription period began in late June 2024.
The detailed subscription-loss calculation is kept once only in Section 9 - Financial Damages. It uses the non-anonymised payment ledger only, excludes unrelated payment categories, and excludes partial months until a complete renewal-cycle export exists.
| Name | Alias(es) | Location | Role | Competing Service |

| Mathew Trojanowski | Kamikaze, Kami, Obviously_Mario, Brief_Ordinary1438 | Nevada, USA | Primary orchestrator - Reddit thread starter, Trustpilot reviewer, code theft, DoS planning | Skynet Killfeed / Anon PVP |
| Edward Griggs Jr. | Crix, Crix Madine Jr, Eddie Griggs | USA | Suicide encouragement, pedo accusations, child targeting, Trustpilot review | BigFatMods |

| Mason Lewis Stockton | Links, havasu | UK | Doxxing (home address), Trustpilot competitor review, Discord alt abuse | whitelist.gg |
| Danny Hayes | - | UK | Self-identified competitor, coordinated Trustpilot review bombing, called for fraudulent chargebacks | Unnamed rival service |

| Brett Jones | MrTechN9ne | Canada | Amplified Reddit thread content on Facebook, made pedo comments | - |
| Ronald "Jarvis" Lund | Jarvis, DayZKillfeed.com | USA | Original antagonist (2020), code theft, threat to "crush" competitors | DayZKillfeed.com |
| Adam Cooper | - | - | Agent of Joel Walker - posted defamatory content on his behalf | - |
The publications carry the following defamatory imputations, each of which is demonstrably false:
| Imputation | Severity | Platforms Published |
|---|---|---|
| Pedophilia - "Soul is a pedo," "kiddy fiddler" | Most serious - "that most terrible of allegations" | Facebook (3+ posts), Discord |
| Fraud / Scamming - "known scammer," "steals files," "takes money and deletes server" | Serious | Reddit (multiple), Trustpilot (multiple), Facebook |
| Criminal Sabotage - "reset loop your server," "code has malicious intent" | Serious | Facebook, Reddit |
| Drug Use - "smokes meth on the regular" | Serious | |
| Professional Incompetence - "chatgpt coder," "no security experience," "broken bots" | Moderate | Trustpilot, Reddit, Discord |
| Code Theft - accused of stealing others' code (ironically, the reverse is true) | Moderate | Reddit, Discord |
All allegations are fabrications. Soul has never been accused, charged, or suspected by any authority of any sex offence, fraud, or criminal conduct. Transaction logs disprove "theft" and "sabotage" claims. The code theft accusation is inverted - the primary orchestrator (Trojanowski) stole Soul's code (confirmed via GitHub commit history: Soul authored 457 of 590 commits, 77.5%).
1. Platform Publisher Liability - Fairfax Media Publications v Voller [2021] HCA 27
The High Court held that platforms facilitating publication of third-party content are publishers. Once a platform has actual knowledge of defamatory content and the capacity to remove it, continued availability constitutes continuing publication. All four platforms in this matter had notice and control.
2. Serious Harm Threshold - s 10A
Comfortably met. Pedophilia accusations are inherently seriously harmful. The publications were extensive (827 days Reddit, 1,894 cumulative public Facebook post-days, 928 Trustpilot review-days), concrete harm is documented (subscriber churn, revenue decline, suicidal ideation), and community witnesses confirm reputational damage.
3. Stage 2 Digital Intermediary Reforms (2023)
The reforms impose obligations on digital intermediaries (platforms) to:
Each platform failed these requirements. Trustpilot records now track 72 reinstatement events. Facebook left content visible for months. Reddit explicitly refused removal after a Concerns Notice. Discord closed a suicide report in 3 minutes.
4. Aggravated Damages - s 35(2)
Aggravated damages are exempt from the statutory cap on general damages (approximately $461,000 AUD for 2025-26). They are awarded where the defendant's conduct increases the harm. Every recognised aggravating factor is present in this case.
5. Innocent Dissemination Defence - s 32
Lost once notice is given and no reasonable action is taken. Each platform here had actual knowledge and capacity to remove. Trustpilot and Reddit received concerns notices. Facebook received a concerns notice and over 117 user reports. Discord received 6+ documented tickets.
Overview: Trustpilot presents the strongest case for platform-as-publisher liability. The tracked record now covers 18 false one-star reviews targeting Legion Killfeed and related DayZ tools, 563 correspondence emails, 72 reinstatement events, 75 refusal events, and 928 cumulative days of defamatory-review visibility or platform-handled review suppression.
Notice history: Trustpilot had notice trails in 2024 and continuing notice through 2025 and 2026. This is not a single August 2025 notice issue; it is repeated publication, removal, reinstatement, filtering, investigation, and refusal after platform knowledge.

Ray Smith / R-y_smith update: the May 2026 review claimed paid access was cut off mid-month after a polite support issue. The Discord record shows the user asked to run Legion with a competitor bot, had already been told the shop/trader feature was being worked on, said he would cancel and come back once fixed, and Legion had already been removed from his DayZ server before the later argument. The "crayons" and "stupidity" lines were automated bot responses triggered by words in the chat, then reused as if they were human support replies.
Legal Exposure: Trustpilot is liable as a primary publisher post-notice. Each reinstatement is a fresh, deliberate publication. A platform that removes, reinstates, filters, suppresses, or keeps investigating defamatory reviews after notice is exercising editorial control, not passively hosting.
On 25 May 2026, Ray Smith / R-y_smith left a 1-star Trustpilot review claiming paid access had been cut off mid-month after a polite support issue. The preserved Discord record shows the user had asked whether Legion could run beside a competitor bot, had already been told the shop/trader feature was being worked on, said he would cancel and come back once fixed, and Legion had already been removed from the DayZ server before the later argument. The preserved review reply also records that the "crayons" and "stupidity" lines were bot auto-replies triggered by wording in the chat, not human support responses.
The review was visible as a three-day-old review in the Trustpilot capture and then hidden while under investigation. It is counted as the 18th one-star review in the Trustpilot scorecard, adding 3 review-days and 1 email to the review-abuse trail.
Overview: Facebook hosts the most visceral defamatory content - including explicit pedophilia accusations published in DayZ gaming groups that function as direct customer acquisition channels. The scorecard records 14 posts by 5 posters, 117 total reports, and 1,894 cumulative days visible. 8 of 14 posts remain VISIBLE as of 10 June 2026.
Concerns Notice Date: 2025-08-14 (Meta Facebook Concerns Notice served). Earlier informal notice through Meta's reporting system from mid-2025. Live chat with Meta staff on 2025-11-02 documented: staff member "Adi" acknowledged the issue, left to "investigate," returned with a scripted deflection after the complainant waited 10+ hours.

Legal Exposure: Under Voller, Meta is liable for continuing publication after notice. Concerns notice was served August 14, 2025. Over 117 reports were filed. A live chat with Meta staff produced nothing. The new Stage 2 reforms require action within 7 days - Meta failed entirely. Absent any removal, Meta cannot invoke innocent dissemination.
Overview: Reddit hosts the single most strategically damaging publication: a persistent thread titled "Legion Kill feed, What's souls issue?" on r/DayZDiscussions, visible for 827 days as of 10 June 2026. The record includes 52 distinct reports, 9 ticket IDs, 4 admin messages, 2024 notice history, and 2025 re-notices while the thread and linked comments remained accessible.
Critical Factor: The thread now ranks as a top-3 Google search result for "Legion Killfeed." Google's AI overview feature has incorporated the defamatory statements into automated summaries - amplifying harm beyond Reddit's audience.

Legal Exposure: Reddit has actual knowledge through the 2024 notice history and later formal re-notice, capacity to remove, and explicitly refused. Under Australian law, Reddit cannot invoke s 230 (US statute). Post-Voller and Stage 2 reforms, Reddit is a continuing publisher. At minimum, access-prevention orders under the new legislation can compel removal even without naming Reddit as a defendant.
Overview: Discord is where the harassment was coordinated and originated, and where Soul's business operates. Uniquely, Discord punished the victim rather than the perpetrators - Soul's account received strikes and restrictions while documented reports of doxxing, threats, rape threats, suicide encouragement, and child targeting were dismissed.
| Date | Ticket | Issue | Discord Action |
|---|---|---|---|
| 2022-11-23 | #30339510 | Mason Stockton doxxing address | Generic "investigation" |
| 2022-11-25 | #30414871 | Others posting address | Generic acknowledgment |

| 2025-11-17 | - | Harassment strike onSoul's account | Appeal filed |
| 2025-11-21 | - | Suicide threat in ticket | Closed in 3 minutes, no reply |
| 2026-01-12 | - | Account "very limited" - 4 violations | Mass reporter tool weaponised |
Perpetrators used a social media mass reporter tool (documented 2026-01-13) to generate false reports against Soul's Discord account, resulting in automated strikes. By January 12, 2026, Soul's account status was "very limited" with 4 active violations - all originating from the attackers' false reports.
Legal Significance: Discord's conduct is the inverse of what platform liability law envisions. Rather than acting against the perpetrators, Discord punished the complainant. The closure of a suicide-related ticket in 3 minutes with no response is egregious for aggravated damages purposes.
Overview: Google is not treated here as the original author of the smear material. The issue is amplification after notice: Search results, snippets, indexed URLs, and AI summary surfaces can keep defamatory claims alive after the original platform has already been notified or has refused to act.
Request 7-1475000041317: On 20 May 2026, Google said some listed Facebook and Reddit URLs were not currently displayed or had been removed, then required confirmation that Facebook and Reddit site-removal procedures had first been used. On 2 June 2026, that confirmation was supplied, including records of reporting, support, appeal, legal, moderation, and review pathways attempted before asking Google to remove, deindex, or stop surfacing the material.
Request 8-8385000040209: On 20 May 2026, Google decided not to act on skynetvslegion.com, Reddit, and Facebook URLs, referred to third-party content/search-engine liability arguments, and requested exact screenshots and country-edition details for AI Mode and AI Overview material.
| Date | Request | Google action | Effect |
|---|---|---|---|
| 2026-05-20 | 7-1475000041317 | Requested proof that Facebook and Reddit removal pathways had been attempted first | Delayed deindexing/removal while defamatory material remained part of the search problem |
| 2026-05-20 | 7-1475000041317 | Decided not to take action on skynetvslegion.com | Search amplification continued unless the source site itself removed the material or a court order was produced |
| 2026-06-02 | 7-1475000041317 | Received proof that Reddit and Facebook reporting, support, appeal, legal, moderation, and review pathways had already been used | Google had notice that the source-platform route had failed |
| 2026-05-20 | 8-8385000040209 | No action on skynetvslegion.com, Reddit, and Facebook URLs; requested exact AI Mode / AI Overview evidence | AI/search-surface issue remained unresolved pending further screenshots and objection details |
Legal Significance: the strongest claim is not that Google created the original posts. It is that, after notice, Google-controlled surfaces can republish, summarise, snippet, rank, or algorithmically amplify the imputations. That makes Google relevant to continuing harm, search damage, and access-prevention strategy.

Danny Hayes on Facebook (July 2025) explicitly instructed others to "do a PayPal chargeback/refund and don't use Legion again" - coordinating fraudulent chargebacks. Evidence shows a wave of PayPal disputes followed within days.
The subscription-loss calculation uses the non-anonymised PayPal subscription ledger only. It counts completed USD subscription receipts and excludes donations, refunds, chargebacks, dispute holds, and unrelated categories from monthly subscription receipts.
May 2026 is excluded from completed-month subscription decline calculations because the ledger contains only a partial May export. Subscription damage can lag by a renewal cycle, so the completed-month window remains July 2024 through April 2026.
The baseline is the completed paid-operation average from January 2025 through August 2025: US$1,007.96 per month. April 2026 produced US$606.97 from 75 customers, leaving a monthly gap of US$400.99.

| Factor | Assessment |
|---|---|
| Gravity of imputations | Most serious category - pedophilia, fraud, drug abuse, criminal conduct |
| Mode of publication | Internet-wide; multiple platforms; permanent/cached; algorithmically amplified |
| Extent of publication | Reddit 827+ days from the 2024 anchor (top Google result), Facebook 1,894 cumulative public-post days, Trustpilot 928 review-days with 0 live, Discord (ongoing) |
| Duration | 3+ years (Oct 2022 - ongoing) |
| Impact on plaintiff | Sole income source; sole developer; documented suicidal ideation; social isolation |
| Failure to retract/apologise | No defendant has retracted; publications remain visible |
The simultaneous publication of defamatory material across four non-compliant platforms (Trustpilot, Facebook, Reddit, Discord) - each amplified by Google Search/AI - is a critical factor elevating the general damages assessment. Notably, TikTok was the sole platform that reviewed the context and acted immediately when Soul raised the 2024 conduct of Griggs and Trojanowski (who attempted to downplay their Discord-based suicide encouragement), demonstrating that prompt platform action is both possible and effective. The remaining platforms' failure to act is therefore inexcusable.
Courts have recognised that multi-platform defamation compounds harm in ways that exceed the sum of individual publications:
| Platform | Primary Audience Function | Harm Pathway |
|---|---|---|
| Trustpilot | Purchase decision point | Potential customers encounter false reviews at the moment of conversion - directly suppresses revenue |
| Community/social groups | Published in DayZ gaming groups functioning asdirect customer acquisition channels - poisons the well where new users discover the service | |
| Search/SEO discovery | Persistent thread rankstop-3 on Google - any person searching "Legion Killfeed" encounters defamation as their first impression | |
| Discord | Operational/business platform | Defamation occurs on the same platform where the business operates - attackers are inside the product itself |
| Google AI | Derivative synthesis | Google AI overviewgenerates new defamatory statements by synthesising content from the above platforms - creating a compounding "echo chamber" effect |
Contrast - TikTok: The only platform that reviewed the context and acted promptly. When Soul raised the 2024 Discord harassment context, and Griggs/Trojanowski attempted to downplay it, TikTok assessed the situation correctly. No defamatory content originated on TikTok itself. TikTok's response proves that the other platforms' inaction is a choice, not a technical limitation.
Key legal implications of multi-platform publication:
In Barilaro v Google LLC [2022] FCA 650, $715,000 was awarded for defamation on a single platform (YouTube/Google). In Wagner v Harbour Radio [2018] QSC 201, $3.7M was awarded for a sustained media campaign across radio and associated platforms. The present case involves four simultaneously non-compliant platforms plus Google AI amplification with longer duration (827 days vs months) and more serious imputations (pedophilia vs political corruption), supporting a valuation at or near the statutory cap for general damages, with the multi-platform context primarily inflating the aggravated damages assessment. The fact that TikTok - the one platform that acted - proves removal is feasible only amplifies the culpability of the four that refused.
| Case | Award | Nature |
|---|---|---|
| Bauer Media v Wilson [2018] VSCA 68 | $650,000 (reduced to $600K) | Serial magazine defamation |
| Wagner v Harbour Radio [2018] QSC 201 | $3,700,000 (4 plaintiffs) | Sustained media campaign |
| Rolph v Smurthwaite [2023] FCA 1556 | $400,000 | Internet defamation - pedophilia imputation |
| Rau v Wieland [2021] SADC 99 | $350,000 | Online defamation - sexual misconduct |
| Barilaro v Google LLC [2022] FCA 650 | $715,000 | YouTube/Google - platform left videos up after notice |
| Rush v Nationwide News [2019] FCA 496 | $2,900,000 | Multiple articles, sustained campaign |
| Martin v Najem [2022] NSWDC 479 | $300,000 + injunction | Social media campaign - "that most terrible of allegations" |
| Colagrande v Kim [2022] FCA 409 | $420,000 | Competitor's false online review + motive to harm |
Given the multi-platform publication factor, general damages are assessed at the upper end of the statutory cap range. Single-platform pedophilia cases achieve $300K-$400K (Rolph v Smurthwaite, Martin v Najem). Four simultaneously non-compliant platforms plus Google AI amplification, over 3+ years duration, justifies 87%-100% of cap across all estimates - particularly when TikTok's immediate remediation proves the other platforms had no excuse.
| Estimate | AUD | % of Cap |
|---|---|---|
| Conservative | $400,000 | 87% |
| Mid-range | $440,000 | 95% |
| At cap | $461,000 | 100% |
| Factor | Evidence |
|---|---|
| Malice | Coordinated campaign with express intent to destroy business |
| Continuation after notice | 72 Trustpilot reinstatements; 827 days Reddit; 1,894 cumulative public Facebook post-days |
| Failure to retract | 75 Trustpilot refusals; 42 Facebook reports ignored; Reddit refusing Concerns Notice |
| Doxxing | Home address published on AggroPVP.com; repeated disclosure |
| Suicide encouragement | "Kill yourself" (Jun 2024); "do your kids a favor" (Jan 2026); victim's suicidal ideation documented |
| Child targeting | Minor children referenced and targeted |
| Rape threats | "Xanax" - 100+ graphic messages |
| Impersonation | Fake "Soul.dev" accounts |
| Competitor motivation | 5 of 15 Trustpilot reviewers are direct competitors |
| Code theft | Primary orchestrator stole plaintiff's code, operates competing service |
| Duration | 3+ years with ongoing escalation |
| Platform weaponisation | Mass-reporting campaigns; victim penalised for reporting |
| Financial sabotage | Explicit calls for fraudulent chargebacks |
The cross-platform orchestration is the single most significant aggravating factor and is what distinguishes this matter from typical single-platform defamation cases. Section 35(2) of the Defamation Act 2005 (NSW) exempts aggravated damages from the statutory cap precisely to address conduct of this severity.
Platform-by-Platform Aggravation Matrix:
| Platform | Days After Notice | Content Still Live | Reports/Notices Ignored | Aggravating Platform Conduct |
|---|---|---|---|---|
| Trustpilot | 199 | 0 reviews (as of February 21, 2026) | 760 emails, 75 refusals | 72 reinstatements; removed content for "defamatory content" then restored it; disabled flagging on reinstated review |
| 191 | 8 of 14 posts | 117 reports | Zero action on 42 reports for explicit pedo accusation; live chat produced scripted deflection after 10-hour wait | |
| 143 | Full thread + comments | 52 report confirmations, 9 tickets, formal Concerns Notice | Explicitly refused Concerns Notice; content ranks top-3 Google result; no action after 27 continuous months | |
| Discord | 1,175+ (first report) | Ongoing incidents | 6+ tickets | Penalised the victim; closed suicide ticket in 3 minutes; automated mass-reporting strikes against complainant |
| 49+ | AI overview + search results | Lumen complaint filed | Claimed URL "not found" while results still display it; AI overview generates derivative defamatory statements |
Cumulative multi-platform aggravation:
The fact that the plaintiff was required to engage in simultaneous, prolonged disputes across four non-compliant platforms - each with different reporting mechanisms, response timelines, and escalation paths - while operating as a sole developer constitutes an extraordinary mitigation burden. TikTok's immediate remediation stands as proof that the process need not be prolonged. The 1,040 documented hours of mitigation effort (valued at $38,900) underscores the practical impossibility of one person combating a coordinated multi-front attack.
Under Carson v John Fairfax & Sons (1993) 178 CLR 44, the manner and extent of publication are primary aggravating considerations. Here, the defendants did not merely publish on one platform - they systematically carpet-bombed every digital surface where the plaintiff's business could be discovered, evaluated, or operated. No comparable Australian case involves this many simultaneously active platforms over this duration.
The aggravated component must be benchmarked against comparable multi-defendant, multi-outlet awards:
| Case | Total Award | Platforms/Outlets | Per-Plaintiff | Key Conduct |
|---|---|---|---|---|
| Wagner v Harbour Radio [2018] QSC 201 | $3,700,000 | Radio + online (multi-outlet) | ~$925,000 | Sustained campaign; corporate plaintiffs; political corruption imputations |
| Rush v Nationwide News [2019] FCA 496 | $2,900,000 | Print + online | $2,900,000 | Sustained campaign; sexual misconduct imputations |
| Barilaro v Google LLC [2022] FCA 650 | $715,000 | YouTube/Google (single platform) | $715,000 | Platform left content up after notice; political figure |
| Present case | - | 4 non-compliant platforms + Google AI | - | Pedophilia (most serious), 3+ years, suicide encouragement, child targeting, rape threats, doxxing, competitor-driven, 995+ ignored reports, victim penalised; TikTok (5th platform) acted immediately - proving removal is feasible |
The present case exceeds the Wagner comparators on every relevant dimension: more non-compliant platforms (4 + Google AI vs 2), worse imputations (pedophilia vs corruption), longer duration (3+ years vs months), additional aggravating conduct (suicide encouragement, child targeting, rape threats) that no comparator case involved - and TikTok's prompt remediation proves the other platforms' inaction is wilful. The Wagner per-plaintiff figure of ~$925K for aggravated + general combined supports an aggravated-only figure in the $400K-$900K range when general damages are assessed separately at cap.
| Estimate | AUD |

The working valuation is now updated to $1,069,272 - $1,998,950 AUD, with a moderate working figure of $1,484,748 AUD. The previous September-style valuation is no longer used because it did not reflect the longer post-September publication period, the completed subscription decline through April 2026, or the larger report/refusal record.
The table uses a 7.8% working allowance for pre-judgment interest across the calculated general, aggravated, and special damages base. The percentage can be adjusted by counsel if a different court-rate approach is required.
| Category | Conservative | Moderate | High |
|---|---|---|---|
| General damages | $400,000 | $440,000 | $461,000 |
| Aggravated damages | $500,000 | $800,000 | $1,200,000 |
| Special damages | $91,904 | $137,317 | $193,314 |
| Pre-judgment interest allowance | $77,369 | $107,431 | $144,636 |
| TOTAL | $1,069,272 | $1,484,748 | $1,998,950 |
The updated range is driven by continued publication after notice, reinstatement and refusal pathways, search/AI amplification, public accusation severity, report-handling burden, and a subscription ledger showing sustained post-trigger decline rather than a one-month dip.
| Element | Status | Evidence |
|---|---|---|
| Identification | Yes | Publications name "Soul," "Legion Killfeed," or "Anthony Brodie" directly |
| Publication | Yes | Public platforms; hundreds to thousands of viewers; Google-indexed |
| Defamatory meaning | Yes | Pedophilia, fraud, sabotage, drug use - unambiguously defamatory |
| Serious harm | Yes | Revenue decline, subscriber churn, suicidal ideation, community ostracism |
| No viable defences | Yes | All allegations demonstrably false; no privilege; innocent dissemination lost |
All four platforms had:
Under Voller, the NSW 2023 reforms, and common law, they cannot claim innocent dissemination.
| Defence | Analysis |
|---|---|
| Truth (Justification) | All allegations are fabrications. No charges, suspicions, or evidence of misconduct. Transaction logs disprove "theft" and "sabotage." The attackers' own inconsistency (calling Soul a scammer one day, begging for access the next) undercuts any truth claim. |
| Honest Opinion | Statements are assertions of fact ("Soul is a pedo"), not opinion on disclosed facts. Malice and false factual premises defeat any "honest" opinion claim. |
| Qualified Privilege | No applicable privilege. Publications were on public internet, not confined contexts. Malice defeats privilege in any case. No public interest in baselessly accusing a private developer of pedophilia. |
| Innocent Dissemination (s 32) | Lost once notice given and no action taken. Each platform had actual knowledge and capacity to remove. Trustpilot received concerns notice andreinstated content. Reddit received a Concerns Notice and explicitly refused. |
| Digital Intermediary (s 31A) | Fails because platforms did not comply with conditions (did not take down in time, did not effectively process complaints). |
Likely defendants:
Under Defamation Act 2005 (NSW) s 12A, treat all cease-and-desist letters and legal notices already served as concerns notices. Re-issue only where a defendant requires an updated or strictly compliant concerns notice covering any post-notice republications and fresh URLs.
Priority targets:
Draft with annexed evidence matrix. Choose NSW Supreme Court (damages likely exceed $750k District Court cap; injunctive powers needed).

This case presents a compelling defamation scenario - a coordinated cross-platform character assassination with platforms complicit after notice. The evidence base of 2,305 evidence files (including 2,338 indexed evidence items) is meticulously documented. All elements of defamation are readily satisfied. No viable defences exist. Platform liability is established through Voller and the Stage 2 reforms. The updated working damages valuation of $1,069,272-$1,998,950 AUD is now tied to the completed subscription ledger through April 2026, the longer publication period, and the enlarged platform report/refusal record.
The primary objectives are:
The case is ready to file. The evidence is organised, the legal framework is clear, and the severity of the conduct warrants the strongest available remedies.
Prepared for litigation support. All financial figures should be independently verified by a forensic accountant prior to filing. Exchange rates should be confirmed against RBA published data.
